1. Area of application

The following terms and conditions apply to all business relationships between Quadroplay and the customer. In each case, the version at the time of the conclusion of the contract is applicable. According to these terms and conditions, customers are both (1) consumers and (2) business owners.

A consumer, according to these terms and conditions, is any natural person who concludes a legal transaction for purposes that cannot be attributed to their commercial nor their independent professional activity.

Business owners, according to these terms and conditions, are natural persons or legal entities or partnerships with legal capacity, with whom business relationships are entered into and who, in the course of concluding a legal transaction, act in relation to their commercial or independent professional activity.

Any conflicting or additional terms and conditions are not part of the contract unless their validity is expressly agreed to in writing. The law of the UK applies.

2. Contract conclusion

The products presented in the online shop do not constitute binding offers, but rather a non-binding invitation to the customer to place an order. Conditions of the goods are non-binding.

The customer makes his legally binding offer with the order. Quadroplay will confirm the receipt of the customer’s order directly. This confirmation does not represent a binding acceptance of the order. This confirmation is only a declaration of acceptance, if the Quadroplay expressly explains this. Telephone orders are not a binding acceptance by Quadroplay. This will only be done by sending an order confirmation in text form (email, fax, letter).

Quadroplay is entitled to accept the offer in the form of an order within 3 working days of receipt. Quadroplay is entitled to refuse acceptance. Quadroplay is entitled to limit orders to a customary amount.

For orders placed electronically, the text of the contract is stored by Quadroplay and sent to the customer after sending the order in text form (email, fax, letter) including the validly incorporated terms and conditions.

3. Reservation of ownership

If Quadroplay enters into a contract of advance payment, the goods remain the property of the seller until full payment has been made.The customer undertakes to treat the goods with care during the period of reservation of ownership, and to inform Quadroplay immediately in writing of all access by third parties, in particular of foreclosure measures, damage or destruction.

4. Prices

The prices quoted in the Quadroplay online shop are binding. The displayed prices are inclusive of the statutory VAT. When shipping orders, the displayed prices do not include the shipping fee. The shipping costs can be found under point 6 of these terms and conditions.

5. Payment methods

Payment can be made either by credit card, debit card or PayPal.

Credit Card: Your credit card will be charged upon completion of the order.

PayPal: If you select this payment method, you will be forwarded to PayPal. When the required data has been entered there, you will automatically be returned to the Quadroplay online shop to complete the order.

6. Shipping costs

The displayed purchase prices are plus shipping costs.

7. Delivery time

Detailed information on the delivery time can be found in the article overview. Delivery times for shipments abroad may be extended.

Please note that all packages of orders with multiple items are handed over to the shipping company at the same time. On delivery, however, it can sometimes happen that not all packages arrive at the same time. For example, orders that include a slide are often delivered at different times.

8. Warranty / Guarantee

  1. Customers can choose whether the rectification should be carried out by repair or replacement. Quadroplay reserves the right to refuse the type of rectification chosen, if this is only associated with disproportionate costs and the other type of rectification does not have any significant disadvantages for the customer.
  2. For customers, the legally required warranty period is two years from the delivery of the goods.
  3. In the case of used goods, the warranty period may be less than two years.
  4. In addition to the warranty, Quadroplay grants customers a limited warranty of six years from receipt of the goods. Exceptions are the curved slide, modular slide, textiles, pool slides and nets. The statutory rights, such as the statutory warranty right, right of withdrawal for customers or general statutory claims for damages are not limited by the guarantee. The guarantee is non-transferable and applies only within the country in which the goods were delivered to the customer.
  5. If Quadroplay recognizes defects, the costs resulting from a return are not covered by this guarantee.
  6. Not covered by the warranty are damage caused by improper handling,
    damage due to incorrect installation,
    damage due to improper storage,
    damage due to natural wear, tear, overload,
    damage due to the use of accessory / supplementary / attachments and care products not approved by the manufacturer,
    damage caused by external influences or events such as windstorm damage, flood damage or water main damage,
    consequential damage that does not arise on the object of sale,
    minor imperfections that do not significantly affect the value or use of the item,
    personal injury.
  7. Warranty services are only provided if the customer can submit by e-mail or in writing, within the warranty period
    an invoice copy or the submitted order confirmation,and photos of the defects of the purchased goods.
  8. For business owners, the statutory warranty period is 1 year from delivery of the goods.
  9. In the case of business, Quadroplay warrants defects in the goods initially at its own discretion by replacement or repair.
  10. Business owners must immediately inspect the delivered goods for quality and quantity deviations and notify recognizable defects within a period of one week from receipt of the goods in writing to Quadroplay. Otherwise the assertion of the claim to warranty is excluded. After becoming aware of hidden defects, they must be reported in writing by the business owner within a period of one week. Deadline is sufficient for the timely dispatch. The business owner bears the full burden of proof for all eligibility requirements, in particular for the defect itself, for the time of the discovery of the defect and for the timeliness of the notice of defect.

9. Transport damage

If goods are delivered with obvious transport damage, please report about such errors immediately to the deliverer and please contact us immediately. The failure to file a complaint or contact has no consequences for its legal claims and their enforcement, in particular their warranty rights. However, they help us assert our own claims against the transport company or the transport insurance.

10. Online Dispute Resolution

Online dispute resolution pursuant to Art. 14 para. 1 ODR-VO: The European Commission provides a platform for online dispute resolution (OS), which can be found at http://ec.europa.eu/consumers/odr/.

We are neither willing nor obliged to attend an out-of-court settlement procedure before a consumer arbitration board.

11. Return Policy

Below you will receive instructions on the condition and consequences of the statutory right of withdrawal for shipping orders.

Right of Cancellation

You have the right to withdraw from this contract within fourteen days without giving any reason. The cancellation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has or has taken possession of the last goods. To exercise your right of withdrawal, you must contact us —

— by means of a clear statement (such as a letter sent by post, fax or email) of your decision to withdraw from this contract. You can use the attached withdrawal form as a template, which is not required. In order to maintain the cancellation period, it is sufficient that you send the notice of the exercise of the right of withdrawal before the expiry of the withdrawal period.

Consequences of withdrawal

If you withdraw from this contract and we have received all payments we have expected from you, including delivery charges (except for additional costs arising from your choosing a different delivery method costing more than the most favorable standard delivery we offer), we will refund you immediately and at the latest within fourteen days from the date on which the notification of your cancellation of this contract has reached us. For this refund, we use the same means of payment that you used in the original transaction, unless otherwise agreed with you. In no case will you be charged for refund fees. We may refuse to refund you until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.

You only have to pay for a possible loss in value of the goods if upon examination the condition, quality and functionality of the goods is reduced due to mishandling.
